Credit Terms

By signing this application, Purchaser agrees to all terms and conditions as listed on each invoice and Seller's standard terms and conditions. Purchaser agrees and covenants that terms are Net 30 days following date of invoice. Purchaser agrees that all payments made on credit terms must be made via ACH, wire transfer, or check. Requests for payment on terms invoices by credit card will incur a transaction processing fee of 3%. A finance charge of 1.5% per month, or the maximum allowed by Purchaser's state, will be charged on all past due invoices. Purchaser further agrees that title to equipment or goods covered by any invoice shall remain with Container and Packaging until paid for in full. Purchaser further agrees to pay, in addition, any collection costs including reasonable attorney fees if collection becomes necessary. Further, Purchaser consents to the personal jurisdiction of the Idaho courts in any collection action. Finally, Purchaser authorizes release of credit information to Container and Packaging.

Individual Personal Guarantee

If company is less than three (3) years old, the following guarantee must be completed by an owner or officer of the corporation.

The undersigned (“the guarantor”) guarantees payment for all indebtedness incurred by the above applicant (“the company”) to Container and Packaging (“the Seller”) whether now due or hereafter incurred. The guarantor also agrees to pay to the Seller reasonable attorney's fees incurred in the collection of such indebtedness. It shall not be necessary for the Seller in order to enforce the obligations of the guarantor to first institute suit or pursue or exhaust its remedies against the company. This personal guarantee shall remain in full force and effect until released by the Seller in writing. The guarantor may give the Seller written notice that this personal guarantee will not operate relative to indebtedness incurred by the company after receipt of that written notice, and the Seller will honor that notice; but this personal guarantee will continue in full force and effect relative to all indebtedness incurred by the company prior to receipt of that written notice. The guarantor hereby consents to the personal jurisdiction of the Idaho courts in all actions relating to this personal guarantee. Please note that a signature followed by a corporate title invalidates the personal guarantee.
